2. Scope and Definitions

2.1. These General Terms and Conditions (GTC) apply to all orders and contracts between Guge SRL and the Customer regarding the sale of "Fall Safe" smart airbag products and related services.

2.2. The Customer may be a consumer (natural person acting for non-commercial purposes) or a business (legal entity or natural person acting in a commercial capacity).

3. Ordering Process and Conclusion of Contract

3.1. The presentation of products on our website constitutes a non-binding invitation to order.

3.2. By placing an order, the Customer makes a binding offer to purchase.

3.3. The contract is concluded when we send an order confirmation email to the Customer or deliver the products, whichever occurs first.

4. Prices and Payment

4.1. All prices are in Euros (€) and include Belgian VAT (21%) but exclude delivery costs.

4.2. Accepted payment methods include:

• Bank transfer

• Credit cards (Visa, MasterCard)

• Bancontact/Mister Cash

4.3. Payment is due immediately upon order placement, unless otherwise agreed.

5. Delivery

5.1. Delivery times are estimates and not guaranteed. Delay in delivery does not entitle the Customer to compensation or cancellation, unless the delay is excessive.

5.2. Delivery occurs within Belgium and other specified European countries.

5.3. Risk passes to the Customer upon delivery to the carrier.

6. Right of Withdrawal for Consumers

6.1. Consumers have the right to withdraw from the contract within 14 calendar days without giving any reason.

6.2. The withdrawal period expires 14 days after the day on which the Consumer acquires physical possession of the goods.

6.3. To exercise the right of withdrawal, the Consumer must inform us of their decision by means of a clear statement using the contact information in Section 1.

6.4. The Consumer must return the goods without undue delay and in any event not later than 14 days from the communication of withdrawal.

7. Warranty and Liability

7.1. We provide a legal conformity guarantee of 2 years according to Belgian law.

7.2. The warranty covers defects existing at the time of delivery.

7.3. Our liability is limited to the contract value and excludes indirect damages, except in cases of willful misconduct or gross negligence.

8. Intellectual Property

8.1. All intellectual property rights related to "Fall Safe" products, including patents, trademarks, and copyrights, remain our exclusive property.

9. Data Protection

9.1. We process personal data in accordance with Belgian data protection law and our Privacy Policy, available on our website.

10. Force Majeure

10.1. We are not liable for failure to perform obligations due to circumstances beyond our reasonable control.

11. Dispute Resolution

11.1. These GTC are governed by Belgian law.

11.2. For consumers: disputes may be submitted to the competent Belgian court or to the Consumer Mediation Service (Service de Médiation pour le Consommateur).

11.3. For businesses: disputes fall under the exclusive jurisdiction of the courts of Brussels.

12. Final Provisions

12.1. Should any provision of these GTC be invalid, the validity of the remaining provisions remains unaffected.

12.2. We reserve the right to modify these GTC. Changes will be communicated and apply to future orders
